[EDITOR'S NOTE: This case is unpublished as indicated by the issuing court.] MEMORANDUM OF DECISION RE: MOTION FOR SUMMARY JUDGEMENT DATED DECEMBER 20, 1990 After a review of the deposition of the plaintiff, taken on March 10, 1989, and the exhibits referred to therein, the court concludes that there are genuine issues as to material facts that remain unresolved.

Accordingly, the motion for summary judgment as to the second and third counts of the plaintiff's complaint is denied.
