Opinion of the Court

[EDITOR'S NOTE: This case is unpublished as indicated by the issuing court.] MEMORANDUM OF DECISION The plaintiff herein failed to perform under the agreement between the parties, Exhibit A. The defendant took reasonable steps to perform in view of the failure of performance of the plaintiff.

Accordingly, any funds held under said agreement, ie. $58,750. are set over and assigned to Angelo Monarca, Inc.

It is so ordered.
