[RE: MOTION TO STRIKE] The court grants the defendant Environmental Construction Services motion to strike the fifth count of the plaintiff's amended complaint. That count fails to state a legally sufficient claim since the plaintiff has not alleged an interest in the land that supports an action for private nuisance.
