Veach v. Bailiff

Veach v. Bailiff
Superior Court of Delaware · Decided July 1, 1852
5 Del. 379

Counsel

Mr. Rodney., Mr. Gcuthrie , Rodney, for plaintiff., Guthrie, for defendant.

Veach v. Bailiff

Opinion of the Court

The Court

over-ruling the objections on the two other grounds, ruled out the deposition, because it was taken after the commission *380was returnable, and of course after the authority of the commissioner ceased.

Rodney, for plaintiff. Guthrie, for defendant.

They suggested that perhaps this might be cured by a special continuance of the commission from term to term, or by a commission without special day of return.

Nonsuit.
