(dissenting).

It is my view that the summary final judgment entered in this case should be reversed under the rule stated in Smith v. City of Daytona Beach, Fla.App.1960, 121 So.2d 440, 442 and Schneider v. K. S. B. Realty & Investing Corp., Fla.App.1961, 128 So.2d 398, 399.
