PER CURIAM.

Upon examination of the record it appears that this appeal was not timely filed. Therefore, the case is dismissed without prejudice to the defendant to apply for proper relief. See Jackson v. State (Fla. App. 4th), 227 So.2d 354, filed October 8, 1969, and cases cited therein.
