Marion v. Pica

Opinion of the Court

PER CURIAM.

Affirmed.

HOBSON, A. C. J., and MANN, J., concur. McNULTY, J., concurs specially with opinion.

Concurring Opinion

McNULTY, Judge

(concurring specially)-

I fully concur in affirming the judgment as to liability in this case, and as to the *547punitive damages. However, I would order a remittitur in the amount of $310.96, representing the temporary replacement of the damaged personalty, for the reason that a proper predicate was not shown as to its necessity.
