266 So. 2d 368; 1972 Fla. App. LEXIS 6303 (Southern Reporter, Second Series)

German v. State

Opinion of the Court

PER CURIAM.

We have reviewed the briefs and record on appeal, and on the basis thereof we are of the opinion that no reversible error has been demonstrated.

The judgment appealed from is, therefore, affirmed.

CROSS and MAGER, JJ., concur. REED, C. J., dissents, with opinion.

Dissenting Opinion

REED, Chief Judge

(dissenting):

I would reverse for an evidentiary hearing to determine whether or not the appellant’s situation requires a new trial on the same principle as was applied in Costello v. State, Fla.1972, 260 So.2d 198.
