Fayerweather v. State

Opinion of the Court

PER CURIAM.

The order under review is the denial of relief sought by a petition for writ of ha-beas corpus.

This denial is affirmed, without prejudice to the appellant filing a motion pursuant to Rule 3.8S0 CrPR in the trial court, contesting the legality of his sentencing, notwithstanding the prior decision of this court reported in Fayerweather v. State, Fla.App. 1972, 258 So.2d 522.

Affirmed.
