Opinion of the Court

PER CURIAM.

On appeal from an order granting summary judgment favorable to appellee, the latter has candidly conceded that a genuine issue of material fact existed and thus it was error for the court to dispose of the case via summary judgment. Accordingly, summary judgment is reversed and the cause remanded for further proceedings.
