PER CURIAM.

Appellant seeks interlocutory review of an order denying its motion for summary judgment in this action for declaratory judgment and other relief. Appellee contends, and we agree, that there were unresolved material fact issues and thus the case was not ripe for disposition by motion for summary judgment.

Affirmed.
