Kish v. State

Opinion of the Court

PER CURIAM.

Upon considering the briefs and record, we find no reversible error. Accordingly, the judgment and sentence are affirmed.

However, this case is remanded with directions that the trial court credit defendant with jail time prior to sentence in accordance with this court’s opinion in Miller v. State, 297 So.2d 36 (Fla.App. 1st, 1974). Resentencing is not required; only entry of an order correcting defendant’s jail time credit.

BOYER, C. J., and MILLS and Mc-CORD, JJ., concur.
