Allen v. State

Opinion of the Court

PER CURIAM.

Allen appeals from an order denying his motion for relief under Rule 3.850, R.Cr. P., urging matters which might have been raised on appellant’s appeal from the judgment of his conviction. Allen’s motion in the court below was his third motion for *95post-conviction relief predicated on the same or similar errors allegedly committed at trial. This appeal is frivolous and is accordingly

DISMISSED.

BOYER, C. J., and MILLS and SMITH, JJ., concur.
