Poston Bridge & Iron, Inc. v. Home Insurance Co.
Poston Bridge & Iron, Inc. v. Home Insurance Co.
Opinion of the Court
Plaintiff, Poston Bridge & Iron, Inc., appeals a summary final judgment for the defendants, The Home Insurance Company and Gladys Xiques. Defendant Home Insurance insured Poston against loss of money resulting from fraudulent or dishonest acts committed by Poston’s employees. Gladys Xiques was an employee of Poston. It was alleged that she converted money belonging to Poston.
Our review of the depositions, answers to interrogatories and responses to requests for admissions convinces us that the record does not conclusively demonstrate that Poston cannot prove any of its claims under its policy against its employee. In order to reach the conclusion that, “the plaintiff is completely without proofs to sustain her comlaint.
