We have reviewed the briefs and record and conclude that there were genuine issues of fact to be tried in regard to the rights of the appellant Rossi and the appellee 4245 Corporation.

*261Accordingly, the order appealed from granting summary judgment for 4245 Corporation is reversed and the cause is remanded for further proceedings.
