Diner's Club, Inc. v. Perez

Opinion of the Court

PER CURIAM.

Appellant, plaintiff in the trial court, appeals a dismissal with prejudice after failing to comply with several court orders.

We have considered the arguments advanced on behalf of the appellant, but find them not to be well-taken and the order under review to be within the discretion of the trial judge. However, we modify the order of dismissal by striking therefrom “with prejudice”.

Affirmed as modified.
