Pincourt v. Oyler
Florida District Courts of Appeal · Decided April 25, 1979 · Cross, Dauksch, Moore
369 So. 2d 1037; 1979 Fla. App. LEXIS 14526 (Southern Reporter, Second Series)

Pincourt v. Oyler

Opinion of the Court

DAUKSCH, Judge.

In this post-judgment dissolution matter the trial court erred in reducing to judgment a debt allegedly owed by the appellant to the appellee. The motion upon which the relief was sought was insufficient to support the judgment and apparently the appellant was not given an opportunity to present a partial defense. The judgment is reversed and this cause is remanded for further proceedings should the appellee properly seek relief.

CROSS and MOORE, JJ., concur.
