Florida District Courts of Appeal · Decided December 5, 1979 · Anstead, Hersey, Letts

Asmussen v. Kicliter

Opinion of the Court

PER CURIAM.

AFFIRMED.

LETTS and HERSEY, JJ., concur. ANSTEAD, J., concurs in part and dissents in part with opinion.

Concurring in Part

ANSTEAD, Judge,

concurring in part and dissenting in part:

While I agree that there is sufficient evidence in the record to support the trial court’s order of modification, I believe the evidence as to the substantial disparity in the financial positions of the parties required that the former wife be awarded attorney’s fees and hence I would reverse for that purpose.
