The petition for writ of certiorari is granted in part and denied in part. The summary judgment of partition is vacated to the extent that it orders the partition of furniture and any other personalty which is .contained in the premises, since with respect to such items there exists a genuine issue of material fact as to the ownership of such personalty. In all other respects, the petition for writ of certiorari is denied.
