American Bakeries v. Weidner
Florida District Courts of Appeal · Decided March 15, 1982 · Smith, Wigginton
410 So. 2d 987; 1982 Fla. App. LEXIS 19457 (Southern Reporter, Second Series)

American Bakeries v. Weidner

Opinion of the Court

PER CURIAM.

There being no showing of causal connection between claimant’s alleged misrepresentation on his employment application and his subsequent heart attack, the employer/carrier’s Martin Company v. Carpenter, 132 So.2d 400 (Fla. 1961) defense must fail. The order of the deputy commissioner finding that claimant suffered a compensa-ble heart attack is affirmed.

ROBERT P. SMITH, Jr., C. J., LARRY G. SMITH and WIGGINTON, JJ., concur.
