Because I believe the evidence which was unavailable at time of trial is crucial to a determination of the merits of the cause and casts doubt upon the credibility of testimony presented at trial, I would reverse the trial court’s Order Denying Motion for Rehearing, vacate the Final Judgment, and remand for consideration of the newly discovered evidence.
