McCord, Mills, Shivers

Cook v. Florida Parole & Probation Commission

Opinion of the Court

MILLS, Judge.

Cook appeals the dismissal of a Section 120.56, Florida Statutes (1981), challenge to the Commission’s Rule 23-19.01(5). We affirm.

The rule is not in conflict with Section 921.16(1), Florida Statutes (1981).

The Division of Administrative Hearings does not have jurisdiction to dispose of constitutional issues in a Section 120.56 proceeding.

McCORD and SHIVERS, JJ., concur.
