Phipps, 93 Fla. 805, 113 So. 419 (1927); Lee v. Patton, 359 So.2d 519 (Fla. 3d DCA 1978), cert. denied, 367 So.2d 1125 (Fla. 1979).

The remaining points raised on appeal lack merit.
