Opinion of the Court

PER CURIAM.

The petition for writ of habeas corpus is hereby denied.

LETTS, C.J., and DOWNEY, J., concur. ANSTEAD, J., dissents with opinion.

Dissenting Opinion

ANSTEAD, Judge,

dissenting:

I would treat the petition as one for mandamus and direct the Florida Parole and Probation Commission to conduct a hearing to determine whether or not petitioner’s prior counsel-less convictions have been utilized to deny him parole. See Jenrette v. Wainwright, 410 So.2d 575 (Fla. 3d DCA 1982).
