Board of County Commissioners v. Shepard
Florida District Courts of Appeal · Decided December 28, 1983 · Ervin, Nimmons, Thompson
444 So. 2d 42; 1983 Fla. App. LEXIS 25313 (Southern Reporter, Second Series)

Board of County Commissioners v. Shepard

Opinion of the Court

THOMPSON, Judge.

The facts and the question of law presented in this appeal are virtually indistinguishable from those presented in Travelers Insurance Co. v. Taylor, 444 So.2d 39 (Fla. 1st DCÁ 1983). Accordingly, the workers’ compensation order in this case is reversed on the authority of Taylor.

NIMMONS, J., concurs. ERVIN, C.J., dissents.

Dissenting Opinion

ERVIN, Chief Judge,

dissenting.

I dissent for the same reasons expressed in Travelers Insurance Company v. Taylor, 444 So.2d 39 (Fla. 1st DCA 1983).
