PER CURIAM.

Despite inconsistencies between the complaint and exhibits attached to the complaint we are of the view that Count III states a cause of action. Thus, we reverse the final judgment with instructions to reinstate the action to this limited extent. We affirm dismissal of the other counts.

REVERSED IN PART; AFFIRMED IN PART; REMANDED.
