Applicators, Inc. v. Gaines
Florida District Courts of Appeal · Decided June 19, 1984 · Bark, Dull, Pearson, Schwartz
452 So. 2d 991; 1984 Fla. App. LEXIS 13892 (Southern Reporter, Second Series)

Applicators, Inc. v. Gaines

Opinion of the Court

PER CURIAM.

Although the jury awarded $20,500 for this item, the record contains evidence of no more than $16,000 in compensatory damages sustained by the plaintiff-appellee as a result of the defendant-appellant’s improper roof repair. Since the errors claimed in the other points on appeal were non-existent, harmless, or waived, the judgment entered below is reduced by $4,500 and is otherwise affirmed.

Affirmed as modified.
