The appellees have filed a notice of confession of error as to the granting of a summary final judgment by the trial court. Upon review of the record we are in agreement with the notice and accordingly, we reverse the summary final judgment with directions that further proceedings be conducted in the trial court, including any ap*47propriate amendments of the pleadings to properly frame the issues in dispute.
