PER CURIAM.

The appellee/defendant having confessed error in the granting of his motion for discharge pursuant to the speedy trial rule, Fla.R.Crim.P. 3.191, the order of discharge under review is reversed, and the cause is *1338remanded to the trial court for further proceedings in accordance with the rule.

Reversed and remanded.
