Kelly v. State

Opinion of the Court

PER CURIAM.

Jaime J. Kelly appeals the denial of his motion filed pursuant to Florida Rule of Criminal Procedure 3.850 to obtain allegedly omitted credit for jail time. Because the state attached an affidavit which omitted the dates of defendant’s arrests, and because the record does not conclusively show that the prisoner is not entitled to relief, we reverse and remand for recompu-tation of jail credit.

Reversed and remanded.
