Fisher v. NCNB National Bank

Fisher v. NCNB National Bank
Florida District Courts of Appeal · Decided June 15, 1988 · Anstead, Glickstein, Gunther
526 So. 2d 222; 13 Fla. L. Weekly 1397; 1988 Fla. App. LEXIS 2494; 1988 WL 59591 (Southern Reporter, Second Series)

Fisher v. NCNB National Bank

Opinion of the Court

PER CURIAM.

We reverse. The trial court erred in granting NCNB National Bank’s motion to dismiss. Fisher’s complaint alleges sufficient facts to state a cause of action in negligence. See Stahl v. Metropolitan Dade County, 438 So.2d 14, 17 (Fla. 3d DCA 1983).

REVERSED AND REMANDED.

ANSTEAD, GLICKSTEIN and GUNTHER, JJ., concur.
