Krarup v. Ohlwiler

Opinion of the Court

DAUKSCH, Judge.

This is an appeal from a final summary judgment. Because there are various vital disputed factual issues to be resolved it was error to enter the summary judgment. Among the issues is whether sufficient notice and due process was granted appellee in a foreign country to warrant recognition of the foreign judgment in Florida. It is *1189improper to enter a summary judgment when disputed material issues of fact exist.

REVERSED AND REMANDED.

ORFINGER and GOSHORN, JJ., concur.
