Florida District Courts of Appeal · Decided March 14, 1990 · Anstead, Gunther, Polen
558 So. 2d 1068; 1990 Fla. App. LEXIS 1496; 1990 WL 26242 (Southern Reporter, Second Series)

North American Van Lines, Inc. v. Ferguson Transportation, Inc.

Opinion of the Court

PER CURIAM.

We grant the petition for writ of certio-rari in part. We quash the trial court's order compelling discovery of documents numbered 7, 8, 9, 12, and a portion of document number 11. We believe the petitioner has demonstrated the existence of a privilege from discovery as to these documents.

ANSTEAD and POLEN, JJ., concur. GUNTHER, J., dissents with opinion.

Dissenting Opinion

GUNTHER, Judge,

dissenting.

I respectfully dissent. I would deny the petition for writ of certiorari. In my view, the petitioner did not demonstrate to the trial court the existence of a privilege from discovery as to documents 7, 8, 9, 12, and a portion of document number 11.
