Benjamin v. State

Benjamin v. State
Florida District Courts of Appeal · Decided March 4, 1992 · Campbell, Hall, Schoonover
593 So. 2d 1236; 1992 Fla. App. LEXIS 2398; 1992 WL 41486 (Southern Reporter, Second Series)

Benjamin v. State

Opinion of the Court

PER CURIAM.

The public defender has filed an Anders brief in this case. However, Darrell Benjamin, pro se, raises two points in this appeal. As to his first point on appeal, the supplemental record filed with this court shows that, contrary to appellant’s assertion, the jury was instructed on the lesser offense of petit theft. We also reject appellant’s contention that there was insufficient evidence of burglary.

Affirmed.

SCHOONOVER, C.J., and CAMPBELL and HALL, JJ., concur.
