Opinion of the Court
The defendants appeal from the denial of a motion to vacate a judgment. We hold that the defendants were denied due process by having a judgment rendered against them while they stood in the proceedings only as nominal defendants. See 67A C.J.S. Parties § 6 (1978). We, therefore, reverse and remand with directions to vacate the judgment and provide the plaintiffs an opportunity to modify the defendants’ posture in these proceedings.
Reversed and remanded with directions.
