We construe paragraph 3 of the agreement as having created contractual obligations on the part of appellees Greg Schaaf and Fred Whaley, as Co-Trustees of the Donald N. Schaaf Trust [substituted as trustees for. the deceased Donald Schaaf], and Schaaf Development, Inc. Accordingly, we reverse the trial judge’s partial final summary judgment and remand for further proceedings consistent with this opinion.

REVERSED AND REMANDED.
