Oxendine v. State
Florida District Courts of Appeal · Decided August 12, 1992 · Anstead, Glickstein, Gunther
602 So. 2d 700; 1992 Fla. App. LEXIS 9059; 1992 WL 191305 (Southern Reporter, Second Series)

Oxendine v. State

Opinion of the Court

PER CURIAM.

AFFIRMED.

GLICKSTEIN, C.J., and GUNTHER, J., concur. ANSTEAD, J., concurs specially with opinion.

Concurring Opinion

ANSTEAD, Judge,

concurring specially.

I agree with the majority that the appellant’s conviction should be affirmed. On *701one issue, that of allowing a police officer to give opinion testimony as to the appellant being the “main guy” in the drug conspiracy alleged, I believe error has been demonstrated. However, upon review of all the evidence, I believe such error was harmless. See State v. DiGuilio, 491 So.2d 1129 (Fla. 1986).
