WOLF, Judge.

Appellant appeals the denial of his motion to dismiss the petition charging delinquency due to escape from a juvenile facility in violation of section 39.112, Florida Statutes (1989). We find the issue to be identical to that in R.A.H. v. State, 614 *882So.2d 1189 (Fla. 1st DCA 1993), and we reverse.
