Florida District Courts of Appeal · Decided November 29, 1995 · Farmer, Klein, Polen

Francisco-Augustin v. Crowder

Opinion of the Court

POLEN, Judge.

We deny petitioner’s petition for writ of habeas corpus.

FARMER, J., concurs. KLEIN, J., dissents with opinion.

Dissenting Opinion

KLEIN, Judge,

dissenting.

I would grant the petition for habeas corpus because the state failed to show, at the hearing on its motion to increase bond, that *13there was either a change of circumstances or new information which was unknown at the original bond hearing. The court thus erred in increasing the bond. Keane v. Cochran, 614 So.2d 1186 (Fla. 4th DCA 1993).
