Kirk v. Gulfstar Development Corp.
Florida District Courts of Appeal · Decided December 20, 1996 · Frank, Quince, Schoonover
687 So. 2d 841; 1996 Fla. App. LEXIS 13270; 1996 WL 729759 (Southern Reporter, Second Series)

Kirk v. Gulfstar Development Corp.

Opinion of the Court

FRANK, Judge.

David and Harriette Kirk appeal from a final order which dismissed a claim of slander of title from their amended complaint filed against Gulfstar Development Corporation. The Kirks argue that the trial court’s consideration of Gulfstar’s motion to dismiss went beyond the four corners of the amended complaint. We agree, quash the order, and remand for further proceedings. See Lowery v. Lowery, 654 So.2d 1218 (Fla. 2d DCA 1995).

SCHOONOVER, A.C.J., and QUINCE, J., concur.
