Nunley v. State
Florida District Courts of Appeal · Decided March 26, 1997 · Dell, Glickstein, Gunther
689 So. 2d 1299; 1997 Fla. App. LEXIS 2797; 1997 WL 134311 (Southern Reporter, Second Series)

Nunley v. State

Opinion of the Court

PER CURIAM.

The state concedes and we hold that the trial court erred in modifying appellant’s restitution four years after entry of the original order of restitution. The trial court did not reserve jurisdiction to modify the amount of restitution after assessing the costs of coun*1300seling for the victim. Accordingly, we quash the amended order of restitution.

GUNTHER, C.J., and GLICKSTEIN and DELL, JJ., concur.
