(dissenting).

I respectfully dissent.

I would reverse the dismissal order under authority of Wood v. Wall, 666 So.2d 984 (Fla. 3d DCA 1996), and remand for a hearing under Venetian Salami Co. v. Parthenais, 554 So.2d 499 (Fla. 1989).
