Opinion of the Court

PER CURIAM.

We accept appellee’s confession of error and abandonment of the cross-appeal. We reverse the final judgment rendered on May 28, 1996, which is the subject of this appeal. We remand this cause to the trial court for such further proceedings as may be necessary consistent with the confession of error and consent thereto.
