Cowart v. Dixie Lime & Stone Co.
Florida District Courts of Appeal · Decided October 30, 1998 · Dauksch, Harris, Sharp
719 So. 2d 1009; 1998 Fla. App. LEXIS 13819; 1998 WL 754568 (Southern Reporter, Second Series)

Cowart v. Dixie Lime & Stone Co.

Opinion of the Court

PER CURIAM.

This is an appeal from two orders of default entered against appellant for failure to answer timely the complaints filed against them by appellees. Because the record demonstrates the clerk’s defaults were nullities and the answers were filed before the court’s defaults were rendered, the answers were filed timely.

ORDERS QUASHED; REMANDED.

DAUKSCH, W. SHARP and HARRIS, JJ., concur.
