I respectfully dissent. Hubbell v. State, 446 So.2d 175 (Fla. 5th DCA), review denied, 453 So.2d 44 (Fla. 1984), disapproved on other grounds, Thomas v. State, 531 So.2d 708 (Fla. 1988).
