The petition seeking a belated appeal of the order of May 20, 1998, denying petitioner’s motion for posteonviction relief in Duval County circuit court ease number 94-11383-CF, is granted. Upon issuance of mandate in this cause, a copy of this opinion shall be filed with the clerk of the lower tribunal and treated as a notice of appeal in accordance with Florida Rule of Appellate Procedure 9.140(j)(5)(D).
