Costello v. State

Opinion of the Court

PER CURIAM.

Appellant, James P. Costello, seeks review of the order denying his omnibus motion seeking return of funds seized from him upon his arrest. Upon review, we conclude that the order should be affirmed since his motion was untimely. Further, section 705.105, *858Florida Statutes is not void for vagueness, nor violative of procedural or substantive due process.

AFFIRMED.
