Boler v. State
Florida District Courts of Appeal · Decided September 3, 1999 · Griffin, Harris, Peterson
741 So. 2d 591; 1999 Fla. App. LEXIS 11857; 1999 WL 682618 (Southern Reporter, Second Series)

Boler v. State

Opinion of the Court

PER CURIAM.

DENIED.

PETERSON and GRIFFIN, JJ., concur. HARRIS, J., concurring specially, with opinion.

Concurring Opinion

HARRIS, J.,

concurring specially:

I agree that in Florida it is permitted to convict and sentence for both the felony murder and the qualifying felony. See Boler v. State, 678 So.2d 319 (Fla. 1996). Therefore it was not ineffective assistance of appellate counsel not to challenge the consecutive life sentences imposed in this case.
