Smith v. State

Opinion of the Court

PER CURIAM.

James Smith appeals an order denying his motion to correct illegal sentence under Florida Rule of Criminal Procedure 3.800(a).

The record reflects that the appellant has raised the substantially identical challenge to his habitual offender sentence on several previous occasions, and relief was denied by the trial court and this court. The motion now before us is procedurally barred as being impermissibly successive.

Affirmed.
