Florida District Courts of Appeal · Decided August 9, 2000 · Edward, Fine, Gross, Klein

Ceramic Tile & Marble v. Poma

Opinion of the Court

PER CURIAM.

We affirm the trial court’s order dismissing count V of appellant’s amended complaint. The count attempted to set up a claim under Chapter 726, Florida Statutes, a statute which, even if it were in effect at the time of the closing, would not apply to a transfer of this type of property.

AFFIRMED.

KLEIN, GROSS, JJ., and FINE, EDWARD H., Associate Judge, concur.
